Welcome to Hurd! These Terms of Service ("Terms") govern your use of Hurd (the "Service"), provided by Join Hurd, Inc. ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Hurd Service We provide a platform for liking, sharing, and posting recommendations, following users, and compiling personalized lists. The Service includes features like uploading content (images, text), engaging with recommendations, and integrating with third-party APIs (e.g., Google). While currently free, we may introduce advertising in the future.

2. Privacy and Data Usage

2.1 Data Collection: We collect information including but not limited to your geographic location, preferences, and engagement history.

2.2 Camera Usage: We use your camera so you can take photos for your profile picture, for board thumbnails, and for adding custom images to the spots you include on your boards

2.3 Photo Library Usage: We use your photo library so you can upload pictures for your profile, boards, and the spots you add to your boards.

2.4 Data Usage: We use this data to personalize your experience and, in the future, to provide relevant advertising based on your location and preferences.

2.5 User Rights: You have the right to access or delete your data.

2.6 Privacy Policy: These Terms also serve as our Privacy Policy, outlining how we handle your information.

3. Community Guidelines

3.1 User Conduct: You agree not to:

Engage in illegal activity or promote recommendations that violate laws (e.g., underage drinking, illicit services).
Post spam, harass others, or share inappropriate content.

3.2 Enforcement: We may remove violating content, suspend accounts, or terminate access for breaches of these Terms.

4. Content Ownership

4.1 License: By posting content, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, modify, display, and distribute your content. This license ends when you delete your content or account, except where it has been shared by others who have not deleted it.

5. Advertisements and Monetization: While Hurd currently operates without advertisements, we reserve the right to introduce personalized ads in the future. These will be based on geographic and user preferences.

6. Dispute Resolution

6.1 Arbitration: Disputes will be resolved through binding arbitration under the rules of the American Arbitration Association. You waive the right to participate in class actions.

7. Limitation of Liability

7.1 Service Provided "As Is": We make no guarantees about the functionality, availability, or reliability of the Service.

7.2 Liability Cap: Our liability is limited to the greater of $100 or the amount you paid us in the past 12 months.

8. Updates to These Terms We may update these Terms as needed. Significant changes will be communicated via app notifications or email. Continued use of the Service constitutes acceptance of updated Terms.

9. Account Termination We may terminate accounts for violating these Terms or at our discretion. Users may also terminate their accounts at any time.
